McDermott ruled that prosecutors years ago had failed to provide sufficient legal instructions to a grand jury as it weighed whether or not to charge Pownall. A Philadelphia judge dismissed all charges Tuesday against former city police officer Ryan Pownall, ruling that prosecutors had failed years ago to provide proper legal instructions to a grand jury as it weighed whether to charge him with murder in a on-duty shooting. In particular, McDermott said during a pretrial hearing, prosecutors had failed to provide the panel with information on how and when officers are legally justified in firing their weapons. Pownall, at the time he was charged, was the first city officer to face a potential murder trial over an on-duty shooting in two decades. Pownall, who is white, was accused of shooting David Jones, a year-old Black man who was carrying a gun when the officer stopped him for illegally riding a dirt bike on a city street.

Larry Krasner was home staring at his television last Tuesday when a person jury in Minneapolis returned a verdict in the Derek Chauvin trial. The high-profile court proceeding, which began 11 months after the Memorial Day killing of then year-old George Floyd, concluded with the year-old defendant being declared guilty of second-degree unintentional murder, third-degree murder, and second-degree manslaughter — the full slate of charges against him. But, he said, this is really a drop in the bucket — so many of these cases were never charged. Had George Floyd been killed in the same controversial manner 20 years ago, but without video, Krasner is confident that Chauvin would have never had his day in court. Historically, he said, very few prosecutors would charge a police officer for anything they did on duty. Activists see the Chauvin verdict as fuel for radical change, including police accountability. That could mean renewed attention for some police killings in Philly. Chief prosecutors, he said, have often put politics before justice. Pownall was fired from the department in September of the same year. However, a month later, a judge reduced the charges to third-degree murder and granted Pownall, a year veteran of the force, bail.

A fired Philadelphia police officer charged with homicide for allegedly shooting a fleeing suspect in the back last year in Juniata was denied bail again at a hearing Wednesday. He is the first city officer in years to face a homicide charge for an on-duty shooting. At Wednesday's hearing, the District Attorney's Office requested that Municipal Court Judge Patrick Dugan hand off the case to a common pleas judge now that a grand jury investigation is complete. In , Dugan became embroiled in controversy for his handling of assault charges against a Philadelphia police lieutenant. Jonathan Josey was charged with punching a woman in the face during a parade in North Philadelphia. Josey was eventually fired and then-Mayor Michael Nutter apologized to the victim. Still, Josey was acquitted by Dugan despite video evidence showing the punch. Critics of the acquittal then pointed to Dugan's marriage to a Philadelphia police officer.
